Chris Brown, partner at specialist law firm Norton Rose, has been in the thick of some exciting port-related finance transactions in recent years, including the Baltic Multi-Port project (at Helsinki, Kotka and Saint Petersburg), the Gdansk Containerport, and a sponsor-driven port project at Valencia, Spain. In the Polish transaction,Norton Rose represented DVB Bank, which is providing up to €100m ($131m) to finance DCT Gdansk, owner of a deepwater container terminal worth €180m ($236m) put out on a 30-year lease to the port authority.The majority shareholder in DCT Gdansk is one of the dozens of infrastructure funds in the Macquarie group.

Troubles and tussles on Spain’s Mediterranean coast

There are problems at the new Prat Dock container terminal under construction in Barcelona where Hutchison has secured terminal operating rights. Around 500m of the new quay line, that will eventually extend for 1,500m, has suffered a major structural problem putting into doubt the ability of the port authority to deliver the terminal to Hutchison on-time. At the time of writing, no statement was forthcoming from the Port of Barcelona on the exact nature of the problems – it is understood detailed investigations are in the process of being implemented – but some observers were suggesting that a severe delay in the terminal’s construction could be expected which could eventually be as much as two years.

DP World calls off Australian merger

DP World has abandoned plans to merge its Australian subsidiary P&O Maritime Services with offshore oil services firm Mermaid Marine Australia. An agreement, which had been reached by both sides in December, would have involved a share swap, leaving DP World with a 60% stake in the joint company. The decision to call off the merger was taken by Mermaid Marine following better than expected financial results. However, public pronouncements by DP World suggest it would still be interested in renegotiating terms.

While Spanish ports continue to do well, future investment planning at Italy’s Gioia Tauro has been cast into doubt following recent strikes in both December and February.Relations between majority-owner Conthship Italia and a new leftwing trade union (SDL) are at a low ebb, despite the fact that the average net income at Gioia Tauro port is €3,000 per annum higher than is found among other workers in the region and €2,000 higher than the average net income across Italian ports as a whole.

Barcelona trawls in transhipment business in defiance of nearby competing terminals

Barcelona-based Tercat moved 1m teu last year, of which around 42% was in the form of transhipped boxes. However, the terminal was never built with transhipment in mind. In fact, according to terminal manager Josep Ollés, the percentage of boxes rotated in and out by sea is a comparatively recent phenomenon, having accounted for just 6% of the total business just three years ago. The main transhipment client is Mediterranean Shipping Company whose throughput at Tercat has not fallen away despite the fact the company now manages its own dedicated terminal in the port of Valencia.
