The new law will no longer allow for container terminal concessions to go ahead on greenfield sites without a public bidding process. The Portonave box facility operation in Navegantes caused major controversy this year past year for allegedly, according to already established container operators, “side-stepping” legislation by obtaining a license from government body Antaq to operate as long as the majority of the cargo was “proprietary cargo”. Critics say that very little of the operator’s cargo is proprietary cargo.<\/p>\n
Critics have also been irritated because Portonave has been operating without paying a fee to the local port authority and without using costly casual labour from the OGMO pool.<\/p>\n
While the “loophole” in the law that allowed Portonave to appear on the scene has been closed, it is understood from sources in Brazil that the legislation is unlikely to be retrospective, so Portonave will not have to close down, as was feared at one point.<\/p>\n
Antonio Carlos Sepulveda, the operations director for Santos Brasil, which has opposed the Portonave greenfield project right down the line, told Port Strategy<\/i>: “I think the decree has made the situation much clearer and I think we have a much better environment now for more investment into Brazilian ports.”<\/p>\n
With the new legislation in place and the rules clarified other major new port developments are now expected to move ahead at Ilheus (near Salvador de Bahia) and Manaus in the Amazonas region.<\/p>\n","protected":false},"excerpt":{"rendered":"
