The fill materials often include rubble from nearly demolishing projects, and this rubble could contain contamination that may slowly migrate towards rivers or neighbouring sites,” he says.

Other areas to consider are sensitive surroundings – harbours are often located close to ecologically significant and pollution sensitive wetland habitats; products loaded/off-loaded – these can contain hazardous compounds and cause pollution of the environment, especially large amounts of fuels/oils, potentially causing hydrocarbon contamination, or coke/coal which might have caused pollution including sulphates, metals, cyanide and polyaromatic hydrocarbons in older port sites.

Leaks from aboveground and underground storage tanks are another risk; when a leak is relatively small and/or located underground, the loss may remain unnoticed for many years, but could cause widespread pollution, warns Mr Barnett.

“In most general liability policies, pollution coverage will not provide any meaningful cover for any historic and/or gradual pollution risks that may exist, but rather usually focus on sudden and accidental pollution risks. Even a sudden and accidental pollution event may not be covered if, for example, an environmental regulator or other statutory body files a claim for damage to the environment rather than a third party suffering bodily injury or property damage,” he says.

● Following an increase in legislation and resulting responsibilities on port operators such as from the introduction of the Corporate Manslaughter and Homicide Act 2007, many port clients are looking at extending cover to include costs and/or prosecution charges incurred in connection with such Acts, says Marsh.

Marsh has been exploring the use of environmental insurance to manage potential pollution liabilities associated with ports and terminal operations.

[16
["post-7943","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-concessions-investments
["GET
