The concession award procedure is currently in progress.<\/p>\n<p>\u201cWe are contributing to the definition of the new role and organisation structure of the ports authority and to the identification and resolution of any organizational gaps,\u201d said Dr Van Hooydonk.<\/p>\n<p>\u201cIn the meantime the commission granted to us and PwC has been extended to include the drafting of an entirely new set of shipping and port regulations, as these will be required for the due diligence studies of the prospective concession holders,\u201d he added.<\/p>\n<p>Elsewhere, Eric Van Hooydonk Lawyers has also won a commission to advise on the status of port land and the terms and conditions of terminal leases awarded by the Klaipeda State Seaport Authority, the largest port authority in Lithuania.<\/p>\n<p>The joint venture with a local law firm was chosen from a list of six local and international consortia of lawyers and consultants. Eric Van Hooydonk Lawyers says the commission itself was in effect a response to a letter of formal notice from the European Commission to Lithuania relating to the terminal contract arrangements pertaining in Lithuanian ports.<\/p>\n<p>\u201cWe made a close examination of the lease and concession contracts in the ports of Hamburg (Germany), Gdansk (Poland), Riga (Latvia), Rotterdam (the Netherlands) and Trieste (Italy). We examined the following aspects for each of these, applicable legislation, port governance model, type of contract, the award procedure, duration, renewability, construction and maintenance works, the status and possibility of mortgaging structures during and upon the end of the contract, throughput and other minimum standards, contractual sanctions, grounds for termination, and the protection of employees in the event of termination.
